01. Acceptance
The ZenithStack Agreement
By accessing the ZenithStack "Growth OS" (the "Service"), you agree to be bound by these Terms of Service. This is a legal contract between ZenithStack LLC ("the Company") and the individual or entity deploying our proprietary infrastructure.
02. Infrastructure Allocation
Tiered Subscription & Billing
ZenithStack is a subscription-based infrastructure layer. Billing is processed via Stripe based on your selected tier ($199, $399, or $1,299/mo). By subscribing, you authorize recurring monthly charges to your payment method until cancellation.
03. Financial Protocol
Finality of Deployment & No-Refunds
Because ZenithStack incurs non-recoverable compute costs upon every deployment, we enforce a strict No-Refund Policy.
- Evaluation is strictly limited to the 3-day trial period.
- Conversion to a paid tier constitutes full acceptance; all sales are final.
04. Governance
The "Publisher of Record" Clause
While our Content Factory and Agents are engineered for high-scale accuracy, you remain the "Publisher of Record". You are solely responsible for reviewing and approving all AI-generated content before it is distributed or published.
05. Ownership Protocol
Proprietary Technology Rights
All GEO algorithms, Content Factory research protocols, and Agent Voice DNA remain the exclusive intellectual property of ZenithStack LLC.
"Reverse-engineering, unauthorized scraping, or attempting to bypass our proprietary security layers will result in immediate termination of service without refund."
06. Liability
Algorithmic Shift Protection
ZenithStack provides the "Engine," but results are subject to third-party algorithmic changes beyond our control. ZenithStack LLC and its Principal Architects are not liable for any fluctuations in brand visibility or citation share-of-voice caused by shifts in OpenAI, Perplexity, or Google protocols.
Our total liability shall not exceed the amount paid by you to ZenithStack LLC during the three (3) months prior to any event giving rise to a claim.
07. Interaction
Architect Conduct Protocol
Strategy or consultancy sessions are strictly for the technical optimization of the Growth OS. Any attempt to solicit private consulting outside the platform or engage in unprofessional conduct with the Principal Architect or other ZenithStack team members will result in permanent account termination without refund.
08. Legal Protocol
Individual Binding Arbitration
Governed by the laws of the State of Delaware. Any dispute shall be settled via individual binding arbitration in Delaware; you waive your right to participate in a class-action lawsuit. The "Principal Architect" and associated individuals are shielded from personal liability by the corporate veil of ZenithStack LLC.
09. Infrastructure Integrity
Account Security & Misuse
You are responsible for safeguarding your credentials. ZenithStack reserves the right to terminate any account immediately if we detect usage patterns that threaten the technical stability of our proprietary infrastructure or violate anti-spam regulations.
10. Technical Evolution
Experimental Features
ZenithStack is a living infrastructure. We reserve the right to rotate or deprecate specific proprietary sub-engines (including specific LLM models or Voice DNA versions) to maintain the overall integrity of the Growth OS. Service is provided on an "as-is" and "as-available" basis.
11. System Resilience
Force Majeure
ZenithStack LLC shall not be liable for any failure to perform obligations where such failure results from causes beyond our reasonable control, including but not limited to: nationwide internet outages, upstream API provider failures, or emergency legislative changes regarding Generative AI.
12. Revenue Disclaimer
Benchmarks & Data Isolation
While ZenithStack provides the engine for high-scale growth, any references to "$1M ARR" or specific growth metrics are architectural benchmarks, not legal guarantees. Your actual results depend on product-market fit and execution.You remain solely responsible for the business outcome.
